1. Introduction

Welcome to myFurever. These Terms of Use (“Terms”) govern your access to and use of the myFurever mobile application, website, and related services (collectively, the “Service”), operated by Furever, LLC (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Service.

2. About myFurever

myFurever is a digital platform designed to help people capture memories, reflect on experiences, and celebrate the bond they share with their pets through photos, videos, written reflections, and AI-assisted storytelling features.

3. Eligibility

You must be at least 13 years old to use the Service. Users between the ages of 13 and 17 must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements. If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Service.

4. Geographic Availability

The Service is currently intended primarily for users located in the United States. Access from other locations may be possible, but we make no representation that the Service complies with laws outside the United States.

5. Account Registration

To use certain features, you need to create an account. You agree to provide accurate information, maintain the confidentiality of your login credentials, and accept responsibility for activity occurring under your account.

6. Account Security and User Responsibility

Users are responsible for maintaining the confidentiality of their account login credentials and for all activities that occur under their account. If you believe your account has been accessed without authorization, you should contact myFurever support promptly. Furever, LLC is not responsible for losses resulting from unauthorized use of an account where the user has failed to safeguard their credentials. You agree to notify us promptly of any unauthorized use of your account or any other suspected security breach.

7. User Content

The Service allows users to upload content including photos, videos, written reflections, captions, comments, and other materials relating to pets and personal experiences. (collectively, “User Content”).

8. Shared Content Visibility

myFurever allows users to invite trusted friends, family members, or other participants to view or contribute to a pet’s memory space or shared content areas within the Service. When a user chooses to share content or invite others to participate, certain photos, videos, reflections, comments, or other materials may become visible to those invited participants. Users are responsible for managing invitations and determining what content they choose to share within these shared spaces.

Furever, LLC does not control how invited participants may respond to, interact with, or emotionally engage with shared content. Users should exercise discretion when sharing personal memories or reflections with others. Participants who are granted access to shared content are expected to respect the privacy and intentions of the person who created or shared the content.

9. User Contributions and Responsibility

Users may have the ability to contribute content within the Service, including photos, videos, reflections, comments, or other materials in shared memory spaces or collaborative areas. By submitting or sharing content through the Service, users represent that they have the necessary rights and permissions to share that content and that the content does not violate the rights of any third party, including privacy, publicity, or intellectual property rights.

Users are responsible for the content they contribute and for ensuring that their contributions are respectful and consistent with the intended purpose of the Service. Content that is unlawful, abusive, threatening, harassing, defamatory, or otherwise inappropriate is not permitted. Furever, LLC does not endorse or assume responsibility for user-contributed content. However, we reserve the right, but not the obligation, to remove or restrict access to content that we reasonably believe violates these Terms or may harm the Service or its users. We may investigate potential violations and cooperate with law enforcement authorities where appropriate.

10. Indemnification

You agree to indemnify, defend, and hold harmless Furever, LLC and its affiliates, officers, directors, employees, contractors, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:

• your use of the Service;
• your User Content or any materials you upload, share, or distribute through the Service;
• your violation of these Terms;
• your violation of any law or regulation; or
• your violation of the rights of any third party, including intellectual property, privacy, or publicity rights.

Furever, LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate reasonably with our defense of the claim.

11. Content Featuring Other People

Users may choose to upload photos, videos, or other content that include images or references to other individuals. By uploading such content, you represent that you have the necessary rights and permissions to share that material within the Service. Users are responsible for ensuring that the content they upload does not violate the privacy, publicity, or other legal rights of others. Furever, LLC reserves the right to remove content that appears to violate these rights or that is otherwise inconsistent with these Terms.

12. Consent to Share Images of Others

If your User Content includes images, videos, or other materials that depict identifiable individuals, you represent that you have obtained any permissions or consents that may be required to share that content through the Service. You agree that Furever, LLC is not responsible for obtaining consent from individuals appearing in user-submitted content.

13. Ownership of Content

You retain full ownership of all User Content you upload. Nothing in these Terms transfers ownership of your content to Furever, LLC.

14. License to Operate the Service

By uploading content, you grant Furever, LLC a limited, non-exclusive, worldwide, royalty-free license to store, host, process, reproduce, modify, distribute and display your content solely for the purpose of operating and improving the Service.

15. Content Guidelines

You agree not to upload, share, create, request, promote, facilitate, or distribute content that:

• violates applicable laws or regulations;
• infringes upon the intellectual property, privacy, publicity, or other legal rights of others;
• contains harassment, threats, hate speech, abuse, or other harmful conduct;
• contains sexually explicit, exploitative, or otherwise harmful material;
• impersonates another person or misrepresents your identity;
• contains malicious software, code, viruses, or other harmful technologies; or
• involves Child Sexual Abuse and Exploitation (CSAE), Child Sexual Abuse Material (CSAM), grooming, solicitation of minors, or any activity that exploits, endangers, sexualizes, or harms children.

Violations of these Content Guidelines may result in content removal, restriction of access to features, account suspension, account termination, referral to law enforcement or appropriate authorities where required by law, or any combination of these actions.

We reserve the right to remove content or restrict access to the Service where we reasonably believe content violates these Terms, applicable law, or the intended purpose of the Service.

You agree not to upload content that violates laws, infringes on intellectual property rights, contains harassment, abuse or threats, contains explicit or harmful material, impersonates another person, or distributes malicious software or harmful code. We reserve the right to remove content that violates these guidelines.

16. Content Moderation and Removal Rights

Furever, LLC reserves the right, but is not obligated, to review, remove, restrict, or disable access to any content at our sole discretion and with or without notice that violates these Terms or that we reasonably believe may be harmful, unlawful, infringing, abusive, or otherwise inconsistent with the intended purpose of the Service. This may include removing content, suspending accounts, or restricting access to certain features where necessary to protect users or the integrity of the Service.

Furever, LLC maintains a zero-tolerance policy for Child Sexual Abuse and Exploitation (CSAE). We may immediately remove content, suspend or terminate accounts, and report suspected violations involving CSAE, Child Sexual Abuse Material (CSAM), grooming, exploitation of minors, or other child safety concerns to law enforcement or other appropriate authorities where required by law or reasonably necessary to protect children.

We reserve the right to investigate suspected violations of these Terms and to cooperate with law enforcement agencies, child protection organizations, regulatory authorities, and other appropriate entities as permitted or required by law.

17. Copyright Infringement (DMCA Notice)

Furever, LLC respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that any content available through the Service infringes your copyright, you may submit a notice requesting removal of the material.

To be effective under the Digital Millennium Copyright Act (DMCA), a notification must include the following information:

• identification of the copyrighted work claimed to have been infringed;
• identification of the material that is claimed to be infringing and information reasonably sufficient to locate the material within the Service;
• your name, mailing address, telephone number, and email address;
• a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
• a statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner; and
• a physical or electronic signature of the person authorized to act on behalf of the copyright owner.

Upon receiving a valid DMCA notice, Furever, LLC may remove or disable access to the allegedly infringing material and may notify the user who uploaded the content. Repeat violations of intellectual property rights may result in suspension or termination of user accounts.

18. Repeat Infringer Policy

Furever, LLC may suspend or terminate the accounts of users who are determined to be repeat infringers of intellectual property rights. We may also remove or restrict access to content that we reasonably believe infringes the rights of others.

19. Data Extraction and Automated Access

Except as expressly permitted through features provided within the Service, users may not access, collect, copy, scrape, download, or otherwise extract data or content from the Service using automated tools or methods, including but not limited to bots, scripts, crawlers, data-mining tools, or similar technologies. This restriction applies to any attempt to systematically retrieve or collect information from the Service, including user-generated content, account information, or platform data.

20. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Service you agree to the practices described in that policy.

21. Third-Party Services and Integrations

Certain features of the Service may rely on services provided by third parties, including but not limited to payment processors, cloud storage providers, artificial intelligence tools, analytics services, and platform providers such as Apple App Store or Google Play.

Furever, LLC does not control and is not responsible for the availability, policies, or practices of third-party services. Your use of such services may be subject to the terms and policies of the respective providers. Where third-party tools are used to support features of the Service, they operate solely to enable the functionality requested by users. Furever, LLC does not guarantee the availability or performance of third-party services.

22. AI-Generated Content

Certain features may generate AI-assisted stories, reflections, summaries, or keepsakes. These outputs are automatically generated based on user inputs and uploaded materials. AI-generated outputs may contain inaccuracies or unexpected results. They are provided for personal enjoyment and reflection only. AI-generated content should not be relied upon as factual, professional, medical, legal, or therapeutic advice. Users should exercise their own judgment when interpreting or relying on any AI-generated output provided through the Service. AI-generated stories or reflections are intended as creative interpretations and may not reflect factual events.

23. User Content and AI Training

myFurever may use artificial intelligence technologies to generate optional stories, reflections, summaries, or other creative content based on information that users choose to provide within the Service. User content—including photos, videos, written reflections, and pet profile information—is processed solely to generate the specific features or outputs requested by the user and to operate the Service.

Unless explicitly stated otherwise in the future, myFurever does not use user-generated content to train general artificial intelligence models or systems. User memories, images, and personal reflections are not used to develop or train external AI models.

Any use of aggregated or anonymized information to improve the functionality, safety, or reliability of the Service will be conducted in a manner designed to protect user privacy. If myFurever ever introduces features that involve broader use of user content for artificial intelligence model training, users will be clearly informed and provided appropriate choices consistent with applicable law.

24. Emotional Reflection Disclaimer

myFurever encourages reflection on the meaningful relationships people share with their companion animals. As part of this experience, users may encounter memories, prompts, or content related to emotional experiences with pets, including topics such as daily life, aging, illness, or the remembrance of a beloved animal. Because myFurever also allows users to invite trusted family members or friends to share in a pet’s story, some interactions between users may involve personal memories, reflections, or emotional responses connected to those relationships. These experiences are a natural part of remembering meaningful bonds. However, the Service is not intended to provide mental health, grief counseling, or therapeutic services. If engaging with memories or conversations becomes emotionally difficult, users are encouraged to seek support from trusted friends, family members, or qualified professionals. Users acknowledge that emotional reactions to memories, reflections, or shared content are subjective experiences outside the control of the Service.

25. Subscriptions and Payments

The Service may offer free and paid subscription plans, including monthly or annual options. Paid subscriptions automatically renew unless canceled. Payment processing may be handled through Apple App Store, Google Play, or other providers. Taxes may apply depending on the user’s location and applicable laws.

26. Subscription Disclosure

Certain features of myFurever are available through optional paid subscriptions. Subscription plans may be offered on a monthly or annual basis and provide access to additional features or expanded functionality within the Service.

Payment will be charged to your account at confirmation of purchase through the applicable app store. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current billing period at the price of the selected plan.

You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings, depending on where the purchase was made. Pricing and subscription options may change from time to time, and any changes will be communicated through the Service before they take effect.

27. Subscription Cancellation

Paid subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date. If you purchased your subscription through the Apple App Store or Google Play, subscription management and cancellation must be completed through your account settings in the respective app store. You can manage or cancel your subscription at any time by visiting your device’s subscription settings.

If you cancel a subscription, the cancellation will take effect at the end of the current billing period. You will continue to have access to subscription features until that period ends. No refunds will be provided for unused portions of a subscription period except where required by applicable law or the policies of the applicable app store. Cancellation does not retroactively refund previously billed subscription fees.

28. Account Deletion

You may request deletion of your account at any time through the Service or by contacting support@myfurevers.com. Deleting the myFurever app or deleting your account does not automatically cancel an active subscription. Subscriptions must be canceled through the app store where the purchase was made. Certain information may be retained as required by law or for legitimate business purposes.

29. Data Export Following Account Cancellation

Users may export their photos, videos, and other personal content from the Service using the tools made available within the application. If a user cancels their account or subscription and is unable to export their content before cancellation, the user may contact customer support within thirty (30) days of account cancellation to request an export of their data. Upon receiving a valid request within this timeframe, myFurever will make commercially reasonable efforts to provide the user with a copy of their available content.

After thirty (30) days following account cancellation, user content may be permanently deleted from active systems in accordance with our data retention practices, and recovery may no longer be possible. Data exports may be provided in commonly used digital formats.

30. Content Backup and Preservation

Users are responsible for maintaining their own copies of photos, videos, reflections, and other content they upload to the Service. While myFurever seeks to maintain reliable systems and may provide tools for exporting user content, the Service should not be used as the sole storage location for important or irreplaceable materials. Furever, LLC does not guarantee that user content will be stored indefinitely or that it will be recoverable in the event of deletion, account cancellation, technical failure, or other circumstances beyond our control.

Users are encouraged to periodically export or download their content using the tools provided within the Service. Following account cancellation, users may request an export of their content within thirty (30) days as described in these Terms. After this period, content may be permanently deleted from active systems and may no longer be recoverable.

31. Intellectual Property

The Service, including its software, designs, graphics, logos, trademarks, and written materials is owned by Furever, LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works without our written permission.

32. Termination

We may suspend or terminate access to the Service if you violate these Terms, your use creates risk or legal exposure for us, or if the Service is discontinued. You may stop using the Service at any time.

33. Service Availability

We strive to maintain reliable access to the Service; however, the Service is provided on an “as available” basis. Furever, LLC does not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue features or functionality of the Service from time to time in order to improve the platform, address security concerns, or comply with legal requirements. Furever, LLC will not be liable for any failure or delay in the performance of the Service resulting from events beyond our reasonable control, including but not limited to natural disasters, internet outages, acts of government, cyberattacks, labor disputes, or failures of third-party services. Temporary interruptions may occur due to maintenance, security updates, or technical issues.

34. Updates and Changes to the Service

Furever, LLC may update, modify, or improve the Service from time to time. These updates may include changes to features, functionality, design, or technical infrastructure. We may also release updates or patches to address security issues, improve performance, or comply with legal or platform requirements. In some cases, continued use of the Service may require installing available updates. While we strive to maintain a consistent experience, we do not guarantee that all features will remain available indefinitely.

35. Beta Features Clause

From time to time, Furever, LLC may make certain features available on a test, preview, or beta basis. These features may be incomplete, experimental, or subject to change. Beta features are provided for evaluation purposes only and may be modified or discontinued at any time without notice.

36. Limitation of Liability

To the fullest extent permitted by applicable law, Furever, LLC and its affiliates, officers, directors, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of, or inability to use, the Service.

This includes, but is not limited to, damages for loss of data, loss of content, loss of goodwill, service interruptions, emotional distress, or other intangible losses, even if Furever, LLC has been advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of Furever, LLC for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:

• the amount you paid to use the Service during the twelve (12) months preceding the event giving rise to the claim, or

• one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

37. Disclaimer of Warranties

The Service and all content, features, and functionality provided through the Service are offered on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Furever, LLC disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• warranties of merchantability;
• fitness for a particular purpose;
• non-infringement;
• accuracy or reliability of information; and
• uninterrupted, secure, or error-free operation of the Service.

Furever, LLC does not warrant that the Service will meet your requirements, that the Service will always be available, or that defects or errors will be corrected. Any content, information, or materials obtained through the Service are accessed at your own discretion and risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.

38. Arbitration and Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration rather than court litigation, except where prohibited by applicable law. Arbitration will be conducted under the rules of the American Arbitration Association. Users waive the right to participate in class action lawsuits and resolve disputes individually. This provision does not prevent either party from seeking relief in small claims court where appropriate.

39. Export Compliance

You agree to comply with all applicable export control and sanctions laws when using the Service. You represent that you are not located in, or a resident of, a country subject to U.S. government embargo or sanctions and that you are not listed on any U.S. government list of prohibited or restricted parties.

40. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

41. Changes to Terms

We may update these Terms periodically. Continued use of the Service after updates constitutes acceptance of the revised Terms. The updated Terms will become effective upon posting within the Service or on the website.
